Terms of Service

These Terms of Service ("Terms") govern your use of Product Photo Finder ("the App," "the Service," "we," "us"), operated by Magnuson Ventures. The Service is available as a Shopify app and as a connector for AI assistants such as ChatGPT and Claude at app.productphotofinder.com/mcp. By installing the app, connecting the connector, or paying for the Service, you agree to these Terms.

1. What the App Does

The App helps you discover product photos from publicly accessible sources on the internet, based on your product titles. You choose which photos to upload to your Shopify store — the App does not upload anything automatically.

1a. Using the Service Through an AI Assistant

When you connect Product Photo Finder to an AI assistant, you or your assistant send us a list of product names. We search for existing photos of each product and return up to four photo links per product, plus a downloadable spreadsheet. Nothing is uploaded to any store by us. You decide which photos, if any, to use. Your assistant acts on your instructions; you are responsible for what it does with your account.

1b. Payments and Refunds

• Prepaid, per product. You buy credits for a number of products before a search runs. Current prices are shown at productphotofinder.com/pricing and quoted by the connector before you pay. Payments are processed by Stripe; we never see your card details.
• You only pay for products we find photos for. When a job finishes, every product with no photo found, and every product that failed on our side, is returned to your balance as a credit automatically.
• Cancelling a job returns the credits for every product not yet searched.
• Billing problems. If you were charged incorrectly or a job did not run, email [email protected] and we will make it right.
• Shopify app purchases are billed by Shopify under Shopify's terms.

2. Merchant Responsibility for Photos

By using the App, you acknowledge and agree that:

• You choose what gets uploaded. The App finds and displays photos as options. You decide whether to upload them. We never upload images to your store without your explicit action.
• Photos may be copyright-protected. Many images on the internet are owned by photographers, brands, or manufacturers and are protected by copyright or trademark law. The App does not verify, guarantee, or represent that any image is free to use commercially.
• You are responsible for verifying rights. Before uploading any image, it is your obligation to confirm you have the legal right to use it on your store. When in doubt, don't upload it — use your own photos or a licensed stock photo service instead.
• We are not liable for copyright claims. Product Photo Finder bears no responsibility — directly or indirectly — for any copyright infringement claim, DMCA notice, trademark dispute, or legal action arising from images you select and upload through the App.
• You indemnify us. You agree to defend and hold harmless Product Photo Finder and its owners from any claim, cost, or liability arising from your use of images uploaded through the App or your violation of any third party's intellectual property rights.

3. Acceptable Use

You agree to use the App only for lawful purposes and in compliance with these Terms and all applicable laws. You may not use the App in any way that could harm others or violate third-party rights.

4. Limitation of Liability

To the fullest extent permitted by law, Product Photo Finder shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App. The App is provided "as is" without warranties of any kind.

5. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it from your Shopify store.

6. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date when changes are made. Continued use of the App after changes means you accept the updated Terms.

7. Governing Law

These Terms are governed by the laws of California, USA.
